REWARD POINTS PROGRAM
TERMS AND CONDITIONS
  1. The Regulations define the general terms, conditions, rules and form of Reward Points Program (hereinafter, the “Program”) operating within ecolore.pl online shop.
  2. The Organizer of the Program is Dorota Fistek-Korbut, conducting business activity under the company Nobilus Dorota Fistek-Korbut, based in Tarnów, Poland through the online shop ecolore.eu (hereinafter referred to as the "Online Shop") and define the rules and conditions for provision of free services by electronic means by Dorota Fistek-Korbut, conducting business activity under the company Nobilus Dorota Fistek-Korbut, based in Tarnów, Poland.
  3. Joining the Program, Participants accept the terms of these Regulations.
Article 1 - Definitions
  1. Program – reward points program for Customers of the Online Shop.
  2. Online Shop - an online shop operating at ecolore.pl.
  3. Shop Website - means web pages, under which the Seller runs the Online Shop, operating in the ecolore.eu domain.
  4. Customer - means an entity to the benefit of which services may be provided by electronic means in accordance with the Rules and Regulations or with which a Contract of Sale may be concluded.
  5. Consumer - means a natural person making a legal transaction with an entrepreneur not directly related to his or her business activity or profession.
  6. Entrepreneur - means a natural person, a legal person, or an organisational unit other than a legal person to which legal capacity is granted by law; such a person shall carry out in its own an economic or professional activity and perform a legal action directly related to its economic or professional activity.
  7. Entrepreneur with Consumer Rights - means a natural person who concludes a Contract of Sale directly related to their business activity, if it appears in the content of the Contract of Sale that they do not have a professional character for that Entrepreneur, which results, in particular, from the subject of their business activity, made available on the basis of the regulations on Central Register and Information on Business Activity.
  8. Participant - a Customer of the Online Shop who is a Consumer or Entrepreneur with the rights of a Consumer who joins the Program in accordance with the conditions set out in the Regulations, who on the date of joining the Program is 18 years old.
  9. Customer Account - means an individual panel for each Customer, established by the Seller after the Customer registration and conclusion of the contract for provision of the Customer Account service.
  10. Registration - means a physical act made in the manner prescribed in the Regulations, as required for use by the Customer of all the functionalities of the Online Shop.
  11. Registration Form - a form containing personal data of a customer setting up a Customer Account in the Online Shop.
  12. Points – units in the Program granted to Program Participants by the Organizer on the terms specified in the Regulations for Registration or the purchase of goods or services by them in the Shop.
  13. Discount - a one-time reduction in the price of ordered goods or services for the Customer.
  14. Coupon Code - a code issued to the Customer, which entitles him to receive a discount (rebate) in a specific amount.
  15. Regulations - means these Terms and Conditions.
  16. Terms and Conditions of the Online Shop - means the regulations specifying the general conditions, rules and method of sale conducted as part of the Online Shop, available on the Website of the Online Shop.
  17. Product - means a product presented by the Seller via the Shop Website which can be a subject of the Contract of Sale.
  18. Contract of Sale – means a contract of sale concluded at a distance under the terms of the Regulations, by and between the Customer and the Seller.
Article 2 - General provisions and use of the Program
  1. The program is designed to reward Participants who purchase products or services in the Online Shop with points entitling to receive discounts, after meeting the conditions set out in the Regulations.
  2. The Organizer reserves the right to exclude the possibility of joining the program permanently or periodically, keeping the rights acquired by the current Participants.
  3. The Terms and Conditions of using the Online Shop's services are described in the Terms and Conditions of the Online Shop.
  4. The rules for the protection of Personal Data are set out in the Privacy Policy.
Article 3 - Conditions for joining the Program and participation in the Program
  1. Joining the Program and participation in the Program is voluntary and related to the use of services provided by the Online Shop.
  2. A Program Participant may be any Customer of the Online Shop who meets the following criteria:
    1. created a free Customer Account in the Online Shop containing truthful data,
    2. and does not belong to the group of customers who receive a special discount on the purchase of products or services at the Online Store.
Article 4 - Collecting Points under the Program
  1. The Participant collects Points on the Customer Account by purchasing products or services in the Online Shop, in accordance with the rules set out in the Regulations.
  2. The Program Participant check the number of Points on the Customer Account via the Website, in accordance with the rules of using the Website specified in the Terms and Conditions of the Online Shop and the Privacy Policy.
  3. Points for the purchase of products or services are collected by Program Participants as follows: the value of the purchase of products or services made by the Participant in the Online Shop is converted into Points in such a way that for each full 1 euro spent on the purchase of products, the Participant receives 1 point, which points are registered (calculated) on the Customer Account.
  4. Points are not awarded on the value of the shipment related to the purchase of products.
  5. The condition for awarding points for the purchase of products and services on the Customer Account is to make the purchase while logged in using the Online Shop Customer Account. If the Participant makes a purchase without logging into his account, Points will not be awarded.
  6. The registration of the purchase of products or services entitling to the reward of Points and the accumulation of Points are possible only at the time of the transaction.
  7. Points in the Program may be accrued only once for each purchase transaction in the Online Shop, after confirmation by the Online Shop staff of receiving payment for purchases of products or services made in the Online Shop.
  8. As part of competitions and promotional activities, Participants may be awarded additional points to the Points indicated in paragraph 3 and 5 above or additional awards, on terms specified separately for periodically conducted actions.
  9. The awarding of points is confirmed by the Organizer via an automatically sent email.
  10. Points accumulated on the Customer Account are valid for a period of 366 calendar days from their accrual.
  11. The customer may be notified by email from the Organizer about the upcoming expiry of the points.
  12. In the event of a return of products for which the Participant has been awarded Points, including as part of a complaint about the purchased products, in which the payment for the products has been refunded by the Online Shop, the Points accrued for the purchase of such products are canceled and cannot be redeemed for a discount.
  13. Points collected on the Customer Account cannot be converted into money, cannot be sold or transferred to a third party.
  14. Points collected on the Customer Account are linked to that specific Customer Account and cannot be transferred to another Customer Account.
  15. The cancellation of the customer's account is tantamount to the irretrievable loss of the accumulated points. Article - 5 Redemption of Points for discounts in the Online Shop
  16. Points collected in the Program are redeemed for a discount of a certain value for purchases in the Online Shop by the Program Participant.
  17. The points are redeemed for a discount according to the parity: 20 points are converted into a discount of 1 euro.
  18. The Organizer reserves the right to change the parity in the Program in the event of a significant change in the value of certain products or services. Within 30 days of providing information about such a change on the Online Shop Website. The Participant has the right to redeem Points for discounts on the same terms.
  19. The points accumulated by the Program Participant on the Customer Account may only be redeemed for a discount by the Participant deciding on the number of points that he wants to redeem on the Cart page before placing the order.
  20. The value of the discount within one order may not exceed the value of products and services not including shipping costs.
  21. Points accumulated on the Customer Account can only be redeemed for discounts.
  22. The redemption of points for a discount is tantamount to subtracting the equivalent number of points from the Customer Account.
  23. In the event of unavailability of the ordered products or services and/or total or partial cancellation of the order, the Organizer returns the number of points used for the discount, including orders to the Customer Account.
  24. The organizer reserves the right to modify the assortment and prices of products and services offered by the Online Shop.
Article 6 - Website and contact telephone number
  1. Information on the Program is available via the telephone number available on the Shop website ecolore.pl.
  2. In order to protect the rights and interests of Program Participants, the Organizer reserves the right to ask questions by persons providing information at the Organiser's telephone number indicated above. Questions will be used to identify the Participant of the conversation and will be asked only if such identification is necessary. In the event of the Participant's refusal to provide identifying information, the Organizer is not obliged, to provide information or to exercise the Participant's rights.
  3. The Organizer reserves the right to temporarily unavailable the Online Shop Website, in whole or in part, for the purpose of servicing.
Article 7 - Complaints
  1. In the event of any irregularities in the calculation of Points on the Customer Account or other irregularities related to the Program, the Participant has the right to submit, within 1 month of noticing such irregularity, but not later than within one year of the occurrence of the irregularity, a complaint with the Organizer or by contact form on the ecolore.pl website. The complaint should be considered by the Organizer, and the Participant should be notified of the complaint disposition within 14 days from the date of receipt of the complaint by the Organizer or via the Website. In the absence of a response within this period, the complaint is considered accepted by the Organizer.
  2. The rules for complaints regarding orders for goods and services for which a discount has been granted are specified in the Terms and Conditions of the Online Shop.
Article 8 - Final provisions
  1. The Organizer shall be liable for non-performance or improper performance of the contract.
  2. The contents of these Regulations may be recorded by being printed, copied to a storage device or downloaded at any time from the Shop Website.
  3. In the event of a dispute related to the concluded Contract of Sale, the parties shall seek to resolve the matter amicably. The Polish law shall be applicable to settlement of any disputes arising under these Regulations.
  4. The Organizer reserves the right to amend these Regulations. The rights resulting from the points accumulated by the Participant before the date of entry into force of the new Regulations are implemented on the basis of the Regulations in force on the date of placing the order by the Customer. The amended Regulations shall enter into force within 7 days from the date of publication thereof on the Shop Website. The Organizer shall inform the Participant 7 days before entry into force of the new Regulations about the amendment to the Regulations by email, including a link to the contents of the amended Regulations. If the Participant does not accept the new contents of the Regulations, the Participant shall notify the Organizer about this fact,
  5. The Regulations shall come into force on 01.04.2021.
